Agreeing to these terms

By using ekrestoration.ca (the "Website"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Website. The Website is operated by EK Restoration Ltd ("EK Restoration", "we", "us") in Ontario, Canada.

Estimate requests are not contracts

Submitting a form or contacting us does not create a contract or guarantee that we will take on your project. Information on this Website, including descriptions of services, timelines, photos and any price ranges, is general and may change. A written estimate or agreement signed or confirmed by EK Restoration is what sets the price, scope and schedule for any work. Some work, such as waterproofing, may require an on-site inspection before we can quote accurately.

Information you give us

You agree that the information you submit is accurate and that you are authorized to request work at the property. You are responsible for the photos and details you send. Please do not send sensitive information such as banking details or government ID numbers through the Website.

Text message terms

• Program: EK Restoration Ltd estimate and appointment text messages. If you check the optional SMS consent box on our estimate form, we may send automated texts to the phone number you provided about your estimate request, appointments, and project updates.
• Consent is optional: the checkbox is separate from the submit button and unchecked by default. You can request an estimate without it, and consent is not required to request an estimate or to buy anything from us. Without consent we will not text you and will contact you by phone or email.
• Frequency: message frequency varies with your project.
• Cost: message and data rates may apply, according to your mobile plan.
• Opt out: reply STOP at any time to unsubscribe. We will send one confirmation message and then stop texting that number. To start receiving texts again, submit a new request and check the box.
• Help and customer support: reply HELP, call (647) 447-1224, or use our contact page.
• Carriers: wireless carriers are not liable for delayed or undelivered messages.
• Privacy: we use Cloudflare and Twilio as service providers to store your request and deliver messages. We do not sell or share SMS opt-in information, mobile numbers or consent with third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy for details.

Using the Website

You agree not to misuse the Website, including by trying to gain unauthorized access, interfering with its operation, submitting false or abusive requests, or using it to send unsolicited messages.

Content and ownership

The text, design, logos and photos on the Website belong to EK Restoration or its licensors and are protected by copyright and other laws. You may view and print pages for personal, non-commercial use. Please do not copy, reuse or republish our content without our written permission. Any third-party names or images appearing on the Website belong to their owners.

No warranty on the Website

We work to keep the Website accurate and available, but it is provided "as is". We do not promise that it will be error-free or always available. This Website is not professional engineering advice. Water, foundation and structural problems should be assessed on site.

Limitation of liability

To the extent permitted by law, EK Restoration is not liable for indirect or consequential losses arising from your use of the Website. This does not limit our responsibilities for work performed under a written agreement with you, or any rights you have under Ontario consumer protection law that cannot be waived.

Links to other sites

The Website may link to other websites. We do not control them and are not responsible for their content or privacy practices.

Changes and governing law

We may update these terms from time to time. The "last updated" date shows the latest version, and continuing to use the Website means you accept the changes. These terms are governed by the laws of Ontario and the federal laws of Canada that apply there, and any dispute will be handled by the courts of Ontario.
